Terms of Use

1. Scope

These terms of use apply to the use of the learning platform gdpr-examtrainer.com (hereinafter "Platform"), operated by JB IT Solutions, a brand of JB Nexus (legal entity: JB Nexus, Inh. Jörg Brose, Wittbräucker Str. 115a, 44287 Dortmund, Germany) (hereinafter "Provider"). By registering for and using the Platform, the user agrees to these terms of use.

2. Description of services

The Platform provides practice questions and learning material to help prepare for the certification exam for Data Protection Officer (DPO) offered by TÜV Rheinland, TÜV SÜD and DEKRA. The content is for study purposes only and is intended as supplementary exam preparation.

3. No guarantee of exam success

Use of the Platform does not guarantee that you will pass the DPO certification exam, nor any particular exam result. The practice questions are based on the subject areas of the TÜV/DEKRA data protection officer exam, but do not reproduce the actual exam questions. The questions on the Platform are independently formulated practice questions that are thematically aligned with the exam content.

Exam success depends on many individual factors, including personal study effort, prior knowledge and the specific exam questions of the respective provider (TÜV Rheinland, TÜV SÜD, DEKRA). The Platform does not replace independent and comprehensive exam preparation.

4. Accuracy of content

All content is created with the greatest possible care and reviewed regularly. Nevertheless, errors cannot be completely ruled out. The Provider gives no guarantee for the accuracy, completeness or timeliness of the questions, answers and explanations provided.

The AI-generated explanations are produced automatically and, despite careful configuration, may contain inaccuracies. They do not replace consultation of specialist literature (e.g. GDPR commentaries) or advice from qualified professionals.

Users are encouraged to report any errors they notice via the built-in feedback function so that they can be corrected promptly.

5. User account and registration

Using the Platform requires registration. The user is obliged to provide accurate information and to keep their login credentials confidential. Each user may only create one account. The Provider reserves the right to suspend or delete an account in the event of misuse or a breach of these terms of use.

6. Subscriptions and payments

The Platform offers free and paid usage options. Paid subscriptions are processed via the payment provider Stripe. Prices are shown on the Platform. Subscriptions renew automatically unless cancelled before the end of the current term.

Cancellation is possible at any time via the account page or the Stripe customer portal. After cancellation, Premium access remains active until the end of the paid term.

7. Right of withdrawal

Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract. To exercise the right of withdrawal, contact us at team@jb-nexus.de with a clear statement of your decision to withdraw from this contract.

Expiry of the right of withdrawal for digital content (Section 356(5) of the German Civil Code, BGB): For a contract for the supply of digital content not supplied on a tangible medium, the right of withdrawal expires before the end of the withdrawal period described above if we have begun performance of the contract after you have (1) given your express consent for us to begin performance of the contract before the withdrawal period has expired, (2) acknowledged that you thereby lose your right of withdrawal, and (3) received confirmation of the contract from us in accordance with Section 312f BGB. When purchasing paid access, we obtain this consent during the order process via a checkbox that is not pre-ticked, and we confirm it to you, together with the contract details, by email.

8. Limitation of liability

The Provider is not liable for damages arising from the use or non-use of the Platform, in particular not for:

  • failing to pass an exam — exam success is expressly not guaranteed
  • incorrect or incomplete content
  • damages caused by temporary unavailability of the Platform
  • data loss

Liability for intent and gross negligence, as well as for damages resulting from injury to life, body or health, remains unaffected. All content is created with care but does not replace legal advice; errors and changes remain reserved.

9. Copyright

All content of the Platform (questions, answers, explanations, text, graphics) is protected by copyright. Reproduction, distribution or any other use beyond the intended use of the Platform is not permitted without the Provider's prior written consent.

Automated scraping, crawling or the use of bots to systematically collect content from this Platform is prohibited.

10. Account deletion

Users can delete their account at any time via the account page. For active subscriptions, cancellation takes effect at the end of the current term, after which the account is deleted. Upon deletion, all personal data is irrevocably removed.

11. Changes to these terms of use

The Provider reserves the right to change these terms of use at any time. Registered users will be informed by email of material changes. Continued use of the Platform after a change constitutes acceptance of the change.

12. Final provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these terms of use be invalid, the validity of the remaining provisions remains unaffected.
